1099-K and 1099-NEC Thresholds in 2026: What Changed

1099-NEC rises to $2,000 for 2026 payments; 1099-K is back to $20,000 and 200 transactions. What that means for freelancers, sellers and drivers — and how to handle duplicate or wrong forms.

What changed: the 2025 tax law raised the 1099-NEC and 1099-MISC threshold from $600 to $2,000 for payments made in 2026, and permanently restored the 1099-K threshold to more than $20,000 and more than 200 transactions. You'll likely get fewer forms for 2026. Your taxable income is exactly the same.

The Three Forms Freelancers and Gig Workers Receive

FormWho Sends It2025 Threshold2026 Threshold
1099-NEC A business that paid you directly (check, ACH, wire) for services $600 $2,000 (inflation-indexed from 2027)
1099-K Payment apps and marketplaces: PayPal, Venmo and Cash App business accounts, Etsy, eBay, Airbnb, Upwork and similar >$20,000 and >200 transactions >$20,000 and >200 transactions
1099-K (cards) Card processors (Square, Stripe, Shopify Payments when you accept cards directly) No minimum No minimum
1099-MISC Payers of rents, prizes, awards and other income (royalties have a separate $10 threshold) $600 $2,000 for most boxes

A note on the 1099-K history: the IRS had planned to phase the threshold down to $600 (it was $5,000 for 2024 and $2,500 for 2025). The One Big Beautiful Bill Act cancelled that phase-down retroactively, so the $20,000 / 200-transaction test applies to 2025, 2026 and later years. Some states require marketplaces to issue 1099-Ks at much lower amounts for state purposes, so you may still get one even if you're under the federal threshold.

The Rule That Doesn't Change: All Income Is Taxable

The thresholds control when a payer must file a form with the IRS. They have nothing to do with whether you owe tax. If a client pays you $1,800 in 2026 and never sends a 1099-NEC, that $1,800 still goes on your Schedule C. You owe self-employment tax once your total net profit from all sources reaches $400.

The practical change for 2026 is that more of your income will be unreported by third parties, which makes your own records the only record. Track every payment as it arrives — invoicing software, a spreadsheet, or a separate business bank account where every deposit is business income.

How to Report 1099-K Income Correctly

A 1099-K shows gross payments: before platform fees, refunds, shipping costs, and chargebacks. That almost never matches your deposits. Report it like this on Schedule C:

  1. Line 1 (gross receipts): total payments received, including the full 1099-K amounts, plus income that didn't come with a form.
  2. Line 2 (returns and allowances): refunds you gave customers.
  3. Expenses: deduct platform fees, payment processing fees, shipping, advertising and other costs on the matching expense lines (Etsy's transaction, listing and payment processing fees are all deductible).

Reporting gross and deducting fees keeps your Schedule C consistent with what the IRS sees, which prevents automated mismatch notices.

Personal payments on a 1099-K

If your 1099-K includes money that isn't income — friends splitting a dinner bill, reimbursements, or personal items you sold for less than you paid — you don't owe tax on it. The IRS instructions are to report that amount on Schedule 1 (Form 1040) as other income and then subtract the same amount as an adjustment, so the form is accounted for but the net is zero. Personal items sold at a gain are capital gains and go on Form 8949. The simplest fix going forward: keep personal and business payments in separate apps or accounts.

Duplicate, Wrong, or Missing Forms

  • Same payment on a 1099-NEC and a 1099-K. Payments made by card or through a payment app belong on the 1099-K only. Ask the client to void or correct their 1099-NEC. If they don't, report your true gross receipts once and keep the invoice, the payment record, and your correction request.
  • Amount is wrong. Ask the issuer for a corrected form. If none arrives before you file, report the correct amount and keep documentation. The IRS may send a CP2000 notice; you respond with your records.
  • Form never arrived. File anyway using your own records. Waiting doesn't change the deadline.
  • Wrong taxpayer ID or name. Get it corrected, or the payer may start 24% backup withholding on future payments.

If You Pay Subcontractors

If your business hires other freelancers, the new threshold means you only file a 1099-NEC for 2026 for a contractor you paid $2,000 or more by check, ACH or wire (payments by card or PayPal are reported by the processor). Keep collecting a Form W-9 from every contractor before you pay them — backup withholding rules use the same $2,000 threshold, and you'll need the W-9 if they cross it. Forms 1099-NEC are due to contractors and the IRS by January 31.
